Last week, the state attorney general's office ruled that towns can regulate, but not ban medical marijuana dispensaries, according to the Boston Herald.
The decision struck down Wakefield's ban, with the attorney general's office saying, “The act’s legislative purpose could not be served if a municipality could prohibit treatment centers within its borders, for if one municipality could do so, presumably all could do so,” reported the Herald.
Selectman Mary Pat Flynn said that the Falmouth Planning Board has an article on the Annual Town Meeting Warrant that if passed would place a moratorium on marijuana dispensaries until April 30, 2014 or until the article is appealed by a vote at town meeting.
"The purpose of the warrant is to give the town time to undertake a planning process to address the potential impacts of in the town, receive guidance from the state, and consider the adoption of new zoning bylaws regarding the operation and location of such center," Flynn said in an email.
